Terms of Use

The rules that govern use of the Loftis real estate operating platform.

1. Acceptance of Terms

These Terms of Use ("Terms") govern your access to and use of Loftis, including our website, dashboards, tenant and owner portals, integrations, and related services (collectively, the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. The Loftis Service

Loftis provides software for real estate investors, owners, and property managers to organize properties, tenants, leases, payments, maintenance, documents, investment analysis, and related workflows. Features may change, be added, or be removed as the Service evolves.

3. Accounts and Authorized Use

You are responsible for maintaining accurate account information and for activity performed through your account. You may use the Service only for lawful business purposes and only for properties, tenants, financial accounts, and data that you are authorized to manage.

You may not attempt to bypass security controls, interfere with the Service, access another user's data without authorization, reverse engineer protected portions of the Service, or use the Service to violate applicable law or third-party rights.

4. Third-Party Services and QuickBooks

Loftis may connect with third-party services such as QuickBooks Online, payment processors, mapping providers, and other vendors. Your use of a third-party service is also governed by that provider's own terms and policies.

If you connect QuickBooks Online, you authorize Loftis to access and exchange the QuickBooks data necessary to provide the features you request, such as synchronizing tenant/customer and property/class information. You can disconnect the integration from Loftis or through Intuit's authorized-app controls.

5. Payments and Financial Information

Loftis may display payment, rent, accounting, cash-flow, investment, or other financial information. Unless expressly stated otherwise, Loftis is not a bank, lender, accountant, attorney, broker, or financial adviser. Calculations and reports are software-generated tools and should be independently reviewed before you make legal, tax, accounting, lending, or investment decisions.

6. Your Data

You retain ownership of the information and content you submit to the Service. You grant Loftis permission to host, process, transmit, and display that information only as reasonably necessary to operate, secure, support, and improve the Service and to provide integrations you enable. Our handling of personal information is further described in our Privacy Policy.

7. Service Availability

We work to keep Loftis available and reliable, but we do not guarantee uninterrupted or error-free operation. Maintenance, third-party outages, internet failures, security events, or circumstances outside our reasonable control may affect availability.

8. Intellectual Property

Loftis and its software, branding, design, interfaces, and original content are protected by applicable intellectual-property laws. Except for the limited right to use the Service under these Terms, no rights in Loftis intellectual property are transferred to you.

9. Suspension and Termination

You may stop using the Service at any time. We may suspend or terminate access when reasonably necessary to address a material violation of these Terms, fraud, abuse, security risk, non-payment, or legal requirement. Where appropriate, we will provide notice and a reasonable opportunity to resolve the issue.

10. Disclaimers and Limitation of Liability

To the maximum extent permitted by law, the Service is provided on an "as is" and "as available" basis. Loftis disclaims warranties not expressly stated in these Terms. To the maximum extent permitted by law, Loftis will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or business opportunities arising from your use of the Service.

11. Changes to These Terms

We may update these Terms as the Service or applicable requirements change. The revised version will be posted on this page with an updated effective date. Continued use after an update means you accept the revised Terms where permitted by law.
